478-1-.05 COMPENSATION PLAN. Amended
SECTION 5.100. PREPARATION OF THE PLAN
After consultation with appointing authorities and the state's fiscal officers, the Commissioner shall prepare and recommend to the Board a compensation plan. The plan shall provide salary schedules and/or pay addenda for the jobs outlined in the classification plan. Such salary schedules shall include minimum, market midpoint, and maximum rates of pay for each paygrade. In establishing such salary schedules, consideration shall be given to the intent and appropriations of the General Assembly, rates of pay in effect in the state departments under the Merit System and in other departments of the State, rates of pay for similar services in other public and private employment, living costs, other benefits received by employees, the state's financial condition and policies, and other relevant factors.(09-19-96/10-01-96)
SECTION 5.200. ADOPTION OF THE PLAN
At public hearings at which employees, appointing authorities, and other interested persons may appear and make known their views, the Board may change the compensation plan in any way it deems desirable and thereupon it shall formerly adopt the plan. The compensation plan shall take effect as adopted upon approval of the Director of the Office of Planning and Budget. (12-14-84/12-27-84)
SECTION 5.300. AMENDMENTS TO THE PLAN
After adoption of the plan by the Board, the Commissioner may, after affording the appointing authorities an opportunity to be heard, amend the compensation plan as may be appropriate, including minimum rates to be paid for each job. The amendments shall take effect upon approval by the Director of the Office of Planning and Budget. (09-19-96/10-01-96)
SECTION 5.400. RECONSIDERATION OF AMENDMENTS TO THE PLAN
The head of any agency affected by amendments to the plan or other compensation decisions made by the Commissioner may request the Commissioner to change such decision. The Commissioner shall review the request and issue a decision no later than thirty (30) days following receipt of the request for review. If disagreements between the department head and the Commissioner continue, the department head may request within fifteen (15) days following the Commissioner's decision for the Personnel Administration Advisory Council, to review and mediate the disagreement. If the Advisory Council is unable to mediate the differences, the agency head may appeal to the Board. The Board's decision shall be final. (09-19-96/10-01-96)
SECTION 5.500. ADMINISTRATION OF THE PLAN
Upon adoption by the Board, the compensation plan and any amendments thereto by the Commissioner shall constitute the official compensation schedule for positions under the Merit System. Other rules and policies supplementing these rules shall provide for the administration of the plan. (09-19-96/10-01-96)
SECTION 5.600. RECOMMENDATION FOR CHANGE IN THE PLAN.
The Commissioner shall annually submit to the Governor appropriate recommendations for changes in the compensation plan. Such recommendations shall include information as needed on adjustments to the entire plan and on specific classes due to economic and labor market conditions and other pertinent data.
